1. Acceptance of These Terms

 

By accessing or using the LUX-TRADER website, submitting an application, creating a member account, purchasing a subscription, or accessing any dashboard or report (collectively, the “Service”), you agree to be bound by these Terms & Conditions (“Terms”).

 

These Terms, together with our Privacy Policy, Refund Policy, and Risk Disclosure Statement, form the entire agreement between you and LUX regarding your use of the Service.

 

If you do not agree to these Terms, you must not access or use the Service.

 

LUX-TRADER’s Services are available only to individuals who:

 

• Are at least 18 years of age, and

• Reside in jurisdictions where our Services are lawfully offered.

 

We may update these Terms at any time by posting a new version on our website. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

2. Nature of the Service (What LUX Is and Is Not)

 

LUX-TRADER provides:

 

• Access to subscription-based membership tiers

• Access to performance information, dashboards, and reports relating to trading systems operated by LUX on funded proprietary trading accounts in LUX’s name

• A revenue-/payout-share structure based on payouts released by third-party proprietary trading firms to LUX

• Educational and informational content about automation, performance structure, and systems used internally by LUX

 

LUX-TRADER does not:

 

• Accept deposits from clients for the purpose of trading

• Manage or trade client-owned trading accounts or funds

• Provide regulated investment services, portfolio management, or investment advice

• Act as a broker, financial advisor, fund manager, or custodian

 

Your subscription grants you informational and contractual access to LUX’s internal funded-account performance and payout-sharing model. It does not constitute an investment product or a promise of returns.

 

3. No Financial Advice / No Investment Services

 

Nothing on the LUX-TRADER website, within our dashboards, reports, communications, or systems should be interpreted as:

 

• Investment advice

• Recommendation to buy, sell, or hold any financial instrument

• Personal financial planning

• A guarantee of profit, income, or performance

 

Our personnel, agents, or representatives are not authorized to provide investment advice. If any communication appears to you as advice, LUX explicitly disclaims such interpretations and shall not be held liable for any reliance placed upon them.

 

You are solely responsible for your own financial decisions. If you require financial advice, you should consult an appropriately regulated financial adviser.

4. Eligibility & Registration

 

By using the Service, you represent and warrant that:

 

• You are at least 18 years old

• You have full legal capacity to enter into binding contracts

• Your use of the Service does not violate any applicable law or regulation in your jurisdiction

• All information you submit to LUX (including forms, applications, and signatures) is true, accurate, and complete

 

You agree to keep your contact, billing, and personal details up to date and to promptly notify us of any changes.

 

You are responsible for safeguarding any login credentials associated with your member account and for all activity occurring under your account.

5. Description of Subscriptions, Tiers & Access

 

LUX offers several allocation tiers (e.g. Tier 1, Tier 2, Tier 3). Each tier may include:

 

• Access to informational performance reports from LUX-managed funded proprietary accounts

• A defined profit-/payout-share percentage (e.g. 30%, 50%, 70%)

• A specified allocation level (e.g. nominal exposure such as £50K, £100K, £200K, etc.)

• A fixed monthly subscription fee

• A possible upfront program fee

 

Full details of each tier (fees, allocation, share percentage, benefits) are set out on our website and/or in your LUX Allocation Participation Agreement.

 

LUX reserves the right to modify, replace, or discontinue any tier or feature at any time, including adjusting fees for new subscribers. Any changes will not affect fees already agreed for the current billing period of existing subscribers, but may apply on future renewals where permitted.

6. Subscription Fees, Billing & Renewals

 

By subscribing to any LUX tier, you agree to pay:

 

• Any applicable upfront program fee, and

• A recurring subscription fee, billed in advance on a monthly (or otherwise specified) basis

 

Key points:

 

• Subscription fees are typically processed via third-party payment processors (such as Stripe, PayPal, or Wix Payments).

• By providing payment information, you authorize LUX and its payment processors to charge your chosen payment method for the fees associated with your chosen tier.

• Unless otherwise stated, subscriptions automatically renew at the end of each billing period until cancelled by you or LUX.

• You are responsible for ensuring your payment method remains valid and has sufficient funds.

• LUX may suspend or terminate your access if payment fails or is reversed.

 

Fees are for access to the Service (including reporting and systems access) and are not contingent upon performance or payouts in any given period.

7. Refunds & Cancellations

 

The basic principles are:

 

• Subscription payments are primarily made in exchange for access to systems, reporting, and allocation rights, not guaranteed payouts.

• Except where required by law or explicitly stated in our Refund Policy, fees are non-refundable once the billing period has started.

• If you wish to cancel your subscription, you must do so before the next billing date.

• Cancellation stops future billing; it does not automatically trigger refunds for past periods.

If you cancel:

 

• You will retain access to the Service until the end of your current billing period (unless otherwise stated).

• You may still receive any payouts already generated before your cancellation date, subject to the terms of your LUX Allocation Participation Agreement.

 

The detailed rules governing refunds, guarantees (if any), and eligibility are set out in our Refund Policy, which is incorporated by reference into these Terms.

 

8. Performance Information & No Guarantees

 

Any performance data, projections, charts, examples, or figures shown on the website, inside dashboards, or in documents are provided for informational and illustrative purposes only.

 

You acknowledge that:

 

• Past performance is not a guarantee or indication of future results

• Performance of funded proprietary accounts can vary significantly over time

• There is no assurance that any account will achieve similar results to historical or hypothetical examples

• Examples of payouts, growth rates, or returns are hypothetical and do not represent typical, promised, or guaranteed outcomes

 

Your subscription should be viewed as a service for access to systems and performance information, not as an assured income stream or investment product.

 

9. Use of the Service & Prohibited Conduct

 

You agree:

 

• To use the Service only for lawful purposes and in accordance with these Terms

• Not to attempt to reverse engineer, copy, resell, or replicate LUX systems, algorithms, dashboards, or internal logic

• Not to share your login credentials with others or sublicense access to third parties

• Not to misrepresent your identity or affiliation in communications with LUX or prop firms

• Not to upload or transmit malicious code, spam, or any content that may interfere with the operation of the Service

 

We reserve the right to suspend or terminate your access immediately if we suspect abuse, fraud, unlawful use, or breach of these Terms.

 

10. Third-Party Services & Proprietary Trading Firms

 

LUX-TRADER relies on third-party providers, including but not limited to:

 

• Website hosting and CRM (e.g. Wix)

• Payment processors (e.g. Stripe, PayPal, Wix Payments)

• Email and automation providers

• Proprietary trading firms that issue funded accounts in LUX’s name

 

You acknowledge and agree that:

 

• Prop firms are independent entities with their own rules, fees, and risk controls

• LUX has no control over changes made by these third parties (including rule changes, payout schedules, or account closures)

• Any interruption or change at the prop-firm level may affect performance and payouts available under your subscription

 

LUX is not responsible for:

 

• Downtime or failures of third-party providers

• Decisions made by prop firms regarding account resets, closures, or bans

11. Intellectual Property

 

All content, systems, automation logic, graphics, dashboards, branding, website design, and related materials provided by LUX-TRADER (the “Content”) are owned by LUX or its licensors and are protected by intellectual property laws.

 

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your own personal or internal business use during your active subscription.

 

You may not:

 

• Copy, reproduce, modify, distribute, or create derivative works based on the Content

• Resell, sublicense, or share the Service or dashboards with third parties

• Use LUX branding, logos, or materials without prior written consent

 

Any unauthorized use of the Content or systems is grounds for immediate termination and may result in legal action.

12. User Feedback & Communications

 

If you send suggestions, feedback, ideas, or other materials (“Feedback”) to LUX, you agree that:

 

• LUX may use such Feedback freely, without obligation to compensate you

• LUX is under no obligation to keep Feedback confidential

• You grant LUX an irrevocable, worldwide, royalty-free license to use, adapt, and implement your Feedback for any legitimate business purpose

13. Personal Data & Privacy

 

Your submission of personal information through the website, forms, or subscriptions is governed by our Privacy Policy, which explains:

 

• What data we collect

• How we use it

• How we store it

• Your privacy rights

 

By using the Service, you agree to our Privacy Policy.

14. Disclaimer of Warranties

 

The Service is provided on an “as is” and “as available” basis.

 

To the fullest extent permitted by law:

 

• LUX makes no warranties or representations, express or implied, regarding the Service, including (but not limited to) implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

• We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

• We do not warrant that performance results or payouts will meet your expectations.

 

You use the Service at your own risk.

15. Limitation of Liability

 

To the fullest extent permitted by law, LUX-TRADER, its directors, officers, employees, agents, and partners shall not be liable for:

 

• Any indirect, incidental, consequential, special, or punitive damages

• Any loss of profits, revenue, data, or business opportunities

• Any losses arising from decisions you make based on information from our Service

 

In any case where liability cannot be excluded, LUX’s total liability arising out of or in connection with the Service shall be limited to the amount of subscription fees you have paid to LUX in the three (3) months immediately preceding the claim.

 

Nothing in these Terms limits or excludes liability where it would be unlawful to do so.

16. Indemnification

 

You agree to indemnify, defend, and hold harmless LUX-TRADER, its directors, officers, employees, contractors, and partners from any claim, demand, loss, or damage (including reasonable legal fees) arising out of:

 

• Your breach of these Terms

• Your violation of any law or third-party right

• Your misuse of the Service

17. Term & Termination

 

These Terms remain in effect while you use the Service or maintain an active subscription.

 

LUX may terminate or suspend your access, with or without notice, if:

 

• You breach these Terms

• You fail to pay subscription fees

• We are required to do so by law or a third-party provider (e.g. prop firm or payment processor)

 

Upon termination:

 

• Your right to access the Service will cease

• You will remain liable for any amounts due up to and including the date of termination

• Certain clauses (e.g. Intellectual Property, Limitation of Liability, Indemnification) will survive termination

 

You may terminate your subscription at any time by following the cancellation process outlined on our website or by contacting support@lux-trader.com.

18. Governing Law & Jurisdiction

 

These Terms and any disputes arising from or relating to them shall be governed by and construed in accordance with the laws of England and Wales (or your actual incorporation jurisdiction, if different), without regard to conflict-of-laws principles.

 

You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction for the resolution of any disputes.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates on our website.

Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
